Overview
Burning Ash Protocol, operated by TripleVision LLC, respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512. This policy describes how copyright owners can report alleged infringement and how users can respond to takedown notices.
Important Technical Note: BAP stores user content in encrypted form using AES-256-GCM encryption. We cannot inspect, review, or access the contents of encrypted documents. This limits our ability to evaluate the substance of copyright claims but does not relieve us of our obligations under the DMCA.

Filing a DMCA Takedown Notice
If you believe content hosted on BAP infringes your copyright, send a written notice to our DMCA Agent containing:
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it (e.g., account identifier, URL)
- Your contact information: Name, address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
- Your physical or electronic signature

DMCA Counter-Notification
If you believe your content was removed in error, you may file a counter-notification containing:
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal court and that you will accept service of process from the complainant
- Your physical or electronic signature

Our Process
Upon Receiving a Valid Takedown Notice
- We will promptly remove or disable access to the allegedly infringing material
- We will notify the affected user of the takedown
- We will forward the takedown notice to the affected user
Upon Receiving a Valid Counter-Notification
- We will forward the counter-notification to the original complainant
- We will inform the complainant that we will restore the material in 10 business days unless we receive notice of a court action
- If no court action is filed within 10-14 business days, we will restore the material
Encryption Limitations
Due to our encryption architecture:
- We cannot verify whether encrypted content is infringing
- Takedown actions are limited to disabling access to the account or encrypted files
- We act on the representations made in the takedown notice
Repeat Infringer Policy
We maintain a policy of terminating accounts of users who are repeat copyright infringers, in appropriate circumstances. Two or more valid, uncontested takedown notices within a 12-month period may result in account termination.
Misrepresentation Warning
Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.
